1. About KTS Cellular Sdn Bhd

(a). Your purchase of goods from www.kts.my (website) is subject to these Terms and Conditions of Sale, the Terms of Use, the Refund and Exchange Policy, the Privacy Policy and any Catalog Terms (collectively referred to here as “Terms”).
(b). www.kts.my is a website operated by KTS Cellular Sdn. Bhd. (“us”, “our”, “we”, “KTS Cellular”). We are a private limited liability company registered in Malaysia and our office is located at No.12, Jalan Kapar, 41400 Klang, Selangor.
(c). You and KTS Cellular may enter into a sale contract for the sale and supply of goods or services described in this website, by you making an offer to KTS Cellular via the website, to purchase the goods and services at the specified price, subject to these Terms.
(d). In these Terms: “you”, “user”, “member”, and “guest” means anyone who visits and/or uses this website
– reference to a “third party” in these Terms includes a reference to any agent or contractor of KTS Cellular, or of any of its related entities, and any person engaged by any of them, in the creation, provision or maintenance of the website or in the fulfilment of Orders made through the website, and includes any of them.

5. Orders

(a). We recommend you carefully preview any proposed Orders before adding them to your shopping cart and proceeding with your Order.
(b). Once an Order has been accepted by KTS Cellular, no cancellation of that Order is valid unless you receive our written communication permitting the cancelled Order.
(c). Representations of goods or services for sale made by KTS Cellular via the website do not constitute an offer to sell but an invitation to treat.
(d). You and KTS Cellular may enter into a contract for the sale and supply of goods or services by you making an offer via the website to purchase goods at the price advertised on the website by:
– Placing an electronic Order for the goods or services using the website.
– You confirm the Order details in accordance with the procedure on the website.
– You making payment in full (plus any applicable delivery and handling charges) on the website.
– The acceptance of that from KTS Cellular

– KTS Cellular receives in its account full payment from you for the goods or services (including any applicable delivery and handling charges) and confirmation of that payment is received by our database.
(f). KTS Cellular reserves the right to refuse to fulfill any purchase or orders from any resellers.

6. You acknowledge that:

(a). The transmission of your offer or the confirmation of any payment, made through an electronic instruction may not be received by KTS Cellular for reasons beyond either parties’ reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications
failure, or the omission or failure of third party website providers or systems.
(b). To the fullest extent permitted by law, KTS Cellular is not liable to you in any way for any loss or damage of any kind, however caused, arising directly or indirectly in connection with the transmission of an electronic instruction through the website, or any failure to receive an electronic instruction for whatever reason.
(c). KTS Cellular may act on and process all completed electronic instructions transmitted or issued through the website without further consent from or reference to you.
(d). KTS Cellular may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions.
(e). You will receive an email from KTS Cellular as soon as practicable after you have confirmed your Order and made payment. Please note this email does not constitute acceptance of your Order by us but merely confirms our receipt of your Order.
– If your Order is not accepted by KTS Cellular, KTS Cellular will notify you by telephone or email and arrange for a full refund of any payment made by you to be processed.
– KTS Cellular may, in its sole and absolute discretion, accept or reject any offer made by you for any reason (or no reason), including an error in the advertised price for, or description of, goods or services on the website, or an error of any kind in or relating to your Order
– Any representations made at any time about stock availability are accurate to the last known stock level and are subject to change. If KTS Cellular cannot supply particular goods, KTS Cellular will notify you by telephone or email as soon as possible.
– KTS Cellular will be deemed to have accepted your Order on the first to occur of issue to you: of a tax invoice for the sale and the fulfilment of your Order.
– Upon the sending to you of the notice of acceptance, KTS Cellular shall be deemed to have accepted your offer, following which no cancellation of your Order by you shall be permitted and no refund shall be made by us in respect of such goods. 7. Price

(a). Prices shown are in Ringgit Malaysia and include GST where applicable. Prices may not include delivery and handling charges. Prices are valid until amended or removed from the website and are subject to change at any time.
(b). Each published saving in respect of goods or services is by reference to the lower of the recommended retail price of the manufacturer or the normal ticketed price of KTS Cellular.
(c). Images of goods shown without any advertised price beside that image are not offered for sale.
(d). Unless otherwise stated, accessories shown in any image of goods are not included in the price.
(e). We reserve the right to correct any errors published on the website at any time.

8. Payment

(a). All payments must be made in full prior to delivery, including any applicable delivery or handling charges.
(b). Payments must be made via the TNS secure payment gateway facilities accessible via the website and will be subject to any additional terms and conditions of these providers.
(c). To the extent permitted by law, we will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by you where a credit card is fraudulently used or is used in an unauthorized manner.
(d). If there is a problem with your payment (for example, if your credit card transaction is declined), we may contact you to make alternative payment arrangements. You will be liable for all debt collection costs where you fail to make payment for any order when payment is due.

9. Supply and Delivery

(a). Subject to you complying with these Terms and acceptance of your Order by KTS Cellular, KTS Cellular will sell and supply the goods or services to you as shown on your Order confirmation.
(b). If the goods that you have ordered are in stock KTS Cellular will endeavor to dispatch orders within one (1) to seven (7) days (Monday to Friday).
(c). When you complete your Order you will be prompted to select whether you wish to collect your Order from a KTS Cellular’s pick up point or to have the Order delivered to an address specified by you.
(d). Delivery dates are estimates only and we are unable to accept any liability for failure to deliver the goods within the specified time resulting from shipment or delivery delays from our suppliers.
(e). If there is no one available to accept delivery on the pre-arranged delivery date, you will be charged for storage, transport and re-delivery costs
(f). Should you arrange your own delivery or collection then the goods become your responsibility upon collection from KTS Cellular’s pick up points.
(g). We cannot accept responsibility for delivery failures or delays by our third party delivery contractor.

10. Delivery by Post or Courier

(a). The terms of this clause apply where you select to have your goods delivered to a specified address.
(b). The delivery address must be an address within Malaysia and cannot be a freight forwarding location.
(c). On acceptance of your Order by KTS Cellular, your Order will be dispatched to your specified delivery address generally within dispatch orders within one (1) to seven (7) business days, subjected to the other provisions of these Terms.
(d). You will be required to be available in person to accept delivery of your Order.
(e). If you wish to change the delivery date or delivery address you must leave a remark on the order, prior to the dispatch of your Order.
(f). KTS Cellular will use its reasonable endeavors to deliver your Order within any stated time frames for dispatch, however KTS Cellular does not warrant that these time frames will always be met, as many factors may affect these time frames.
(g) KTS Cellular cannot and will not accept responsibility for delivery failures or delays by our third party delivery contractor.
(h) You are required to inspect your goods when you take delivery of them. You will be required to note any damage on the delivery documentation which is presented to you by the carrier for signature. In all other cases you will be required to notify us in writing of any damage on delivery or shortages within seven (7) days of delivery. We will not be liable for any damage on delivery to any of the goods unless we are notified within the time period specified above.

11. Orders for Collection at a KTS Cellular Store

(a). The terms of this clause apply where you select to collect your Order from a KTS Cellular Store.
(b). If you select to collect your goods from a KTS Cellular Store a representative of the relevant KTS Cellular Store will contact you by telephone or email to notify you when the Order is available for collection.
(c). Orders for collection at a KTS Cellular Store must be collected within seven (7) days of the relevant KTS Cellular Store giving you notice by telephone or by email that your Order is available for collection. If your Order is not collected within this time, the relevant KTS Cellular Store has the right to allocate those goods to another customer and reorder the goods for you.
(d). The person who collects the goods must provide the order confirmation print out, photo identification and present the credit card used for the online transaction. If the person is unable to collect the order instore personally, the person must email to [email protected] to notify us of the name of the person nominated to collect the order on behalf.

12. Title and risk in goods

Title and risk in goods pass to you on delivery or collection and after full payment has been received by KTS Cellular.

13. Payment and credit card fraud

To the fullest extent permitted by law, KTS Cellular and its related entities will not be responsible for any damages or consequential losses of any kind (whether direct or indirect) suffered by a user where a credit/debit card or other payment method is fraudulently used or is used in an unauthorized or improper
manner.

14. Disclaimer and Indemnity

(a). To the fullest extent permitted by law (and without limitation to any other provision of these Terms), KTS Cellular, and each of its related entities, exclude all liability to you or anyone else for any and all loss or damage of any kind (however caused or arising) relating in any way to the website (or any goods or services purchased on the website) including, but not limited to, loss or damage you might suffer as a result of:
– you acting, or failing to act, on any information contained on or referred to on the website and/or any linked website.
– personal injury or property damage of any kind resulting from your access or use of the website.
– any unauthorized access to or use of the websites secure servers.
– any interruption or cessation of transmission to or from the website.
– any bugs, viruses, trojan horses or other harmful code or communications which may be transmitted to or through the website by any third party.

(c). Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the goods or services on the website. Any representation, condition or warranty which might be
incorporated into these Terms by statute, common law, the law of equity or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that any goods or services are suitable for your purposes.
(d). You will at all times indemnify, and keep indemnified, KTS Cellular, and each of its related entities, including their directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by any of them arising from any claim, demand, suit, action or proceeding by any person against you or them where such loss or liability arose out of, in connection with or in respect of your conduct or any breach of these Terms

17.Your Right To Cancel Your Order (Right of Withdrawal)

Subject to the terms set out below, you have the right to cancel your Order and return the goods up to seven (7) business days starting from the day the goods are received by you, provided the goods are in perfect condition and the packaging remains in an ‘as new’ state, and provided that
(i). You will be responsible for the cost of returning the goods to us. A full refund of the value of the goods will be made upon our receipt of the returned goods.
(ii). You have proof of purchase (order invoice number and receipt).
(iii). The goods must be in new condition and returned in the original, unopened packaging along with all original accessories (including manuals, warranty cards, certificate of authenticity) and any free gifts received with it.
(iv). All sealed items must not be opened.
(v). The product must not have been used or installed or had any data inputted.
(vi). If delivery has taken place, the refund will exclude delivery charges paid.
(vii). One exchange is allowed per purchase. The exchange product will not be eligible for further exchange or refund unless faulty.

18. Force Majeure

KTS Cellular will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond their reasonable control, including but not limited to failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries

19. Governing Law

The courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our website or any Order placed on the website, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms are governed by Malaysia law.

20. Severability

If any part of these terms are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these terms and the remaining terms and provisions of these terms will remain in force and constitute the agreement between you and KTS Cellular.

21. Waiver

The failure by KTS Cellular to exercise or enforce any right or provision under these terms will not constitute a waiver of such right or provision. Any waiver of any provision under these terms will only be effective if it is in writing and signed by KTS Cellular.

General Terms and Conditions

1. The redemption item is provided on an ‘as is’ basis and strictly cannot be exchanged or refunded or replaced with other or different redemption item/ models/ products.
2. Once user has placed a redemption and it is accepted by Samsung Malaysia Electronics (SME) Sdn Bhd (‘SME’), his/her redemption request cannot be revoked, cancelled or be exchanged. Once you have redeemed your Rewards Points, they will be considered extinguished and strictly cannot be reinstated.
3. KTS Malaysia and SME shall not be liable in any way for any costs, expenses, damages, liability or injury arising out of or in any way connected with the acceptance and/or usage of the Evoucher.
4. All images are for illustration purposes only.
5. SME reserves the right to alter, cancel, extend, terminate or suspend the E-voucher or any part thereof, or any part of the applicable terms and condition from time to time, with or without any prior notice. In case of any disputes directly or indirectly arising from the E-voucher, Samsung reserves the right to make the final decision. Samsung’s decision is final and no further correspondence or appeal will be entertained.
6. SME will not reimburse, compensate or otherwise be held responsible for any lost, stolen or deleted E-voucher.
7. SME reserves the right to cancel, suspend, revoke or terminate the redeemed item or any of your Rewards Points earned or accrued in your Samsung Rewards Account that is suspected to be a result of fraud or any irregular transaction, or if SME believes that user’s transactions and/or reward points has been manipulated in any way by machines or computers or the user has committed a breach of these terms and conditions, terms and conditions governing your Samsung Account, your Samsung Rewards Account or any other account, product, facility, service(s) granted by SME to you.
8. SME reserves the right to cancel or modify or revoke the use of the voucher codes or redemption, where the vouchers are used in the following circumstances: suspicious or fraudulent voucher use, voucher abuse, including voucher redeemed using multiple accounts or multiple checkouts associated with the same user/customer and/or voucher used in bad faith (including resold
voucher or use of voucher orders made and intended for resale).
9. By redeeming the E-voucher, user agrees to release and hold SME and its employees, officers, directors, shareholders, agents, representatives, parent companies affiliates, subsidiaries, licensees, advertising, promotion, and fulfilment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the E-voucher redemption or resulting from acceptance, possession, use or misuse of the E-voucher or from any gift-related activity, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
10. SME will not assume any responsibility or liability for the E-voucher and SME expressly excludes and disclaims any representations, warranties or endorsement, implied or express, written or oral, of the E-voucher offered under this reward, including but not limited to any warranty of quality, merchantability, fitness for a particular purpose, health and safety. The E-voucher is offered solely by the merchant under such terms and conditions as may be determined by the merchant. Any dispute arising from or in connection with the E-voucher offered by the merchant shall be resolved by the users directly with the merchant.
11. By participating in this redemption, you agree that the collection of such information will be processed, handled and used in accordance with the Samsung Privacy Policy at http://www.samsung.com/my/info/privacy.html.
12. The terms and conditions herein shall be governed by laws of Malaysia and any dispute arising out of or in connection with the terms and conditions and this e-voucher shall be referred to the exclusive jurisdiction of courts of Malaysia.
